1. Scope and Global Compliance

This Privacy Policy governs the collection and processing of personal data by Urban Dulhaniya ("the Firm"). We operate under a "Privacy by Design" framework, compliant with:

  • India: Digital Personal Data Protection Act (DPDP), 2023.
  • EU/UK: General Data Protection Regulation (GDPR).
  • USA: CCPA/CPRA (California) and VCDPA (Virginia).
  • Shopify Ecosystem: Compliance with Shopify's Merchant Data Processing Addendum.

2. Enhanced Data Collection: Bespoke & Virtual Services

To provide luxury tailoring, we collect:

  • Anatomic Data: Precise body measurements.
  • Multimedia Data: Photos, videos, and sketches. Note: These are encrypted and accessible only by our Design Masters.
  • Consultation Records: Recordings of video sessions (WhatsApp/Zoom/Meet) for design verification.
  • Minors: We do not knowingly collect data from individuals under 18 without explicit parental/guardian consent.

3. Third-Party Integrations & International Transfers

We share data only with "Essential Service Providers":

  • Platform: Shopify Inc. (Data Hosting & Checkout).
  • Financials: Razorpay/PayPal. We never see or store your raw credit card data; it is tokenized via PCI-DSS compliant vaults.
  • Logistics: DHL, FedEx, BlueDart.
  • Marketing: Meta (Pixel), Google (Tags), and Pinterest.
  • Cross-Border: Data is primarily processed in India. For EU/US clients, we utilize Standard Contractual Clauses (SCCs) to ensure high-tier protection.

4. Anti-Fraud & "Unboxing" Protocol

To protect the brand from fraudulent "Damage Claims":

  • Internal Recording: We record the 360° final packaging of every garment.
  • Mandatory Unboxing Video: As per our Store Policy, any claim of "Manufacturing Defect" must be accompanied by a continuous, unedited unboxing video.
  • Legal Use: This video data is stored for 30 days post-delivery or until the dispute is resolved.

5. Your Rights & "The Right to be Forgotten"

You have the right to:

  • Access/Correction: Update measurements at any time.
  • Erasure: Request deletion of your data, excluding records we are legally required to keep for Indian Tax Audit (GST) purposes.
  • AI Clause: Your photos/videos will never be used by us to train AI models or for marketing unless a separate "Model Release" is signed.

6. Data Security & Breach Protocol

  • Encryption: We use 256-bit SSL encryption.
  • Breach Notification: In the unlikely event of a data breach, Urban Dulhaniya will notify the relevant Data Protection Board and affected users within the statutory timelines (72 hours where applicable).

7. Strict Jurisdictional Clause

Legal Notice: All data-related interactions are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the Courts in Pune, Maharashtra, India.
